In her article “Interim Measures in International Arbitration and the New York Convention”, Aida Avanesyan, a member of the Armenian Arbitrators’ Association, explores the role of interim measures as an essential safeguard for the effective conduct of proceedings and the enforcement of future awards. Such measures, including asset freezing or temporary suspension of contractual obligations, are aimed at protecting the parties’ rights, yet their enforcement largely depends on the domestic legislation and judicial systems of each country.
The article also highlights the limits of applicability of the New York Convention. While it serves as a cornerstone instrument ensuring the recognition and enforcement of international arbitral awards, interim measures are not always covered by its scope. This creates practical challenges and underlines the importance of strengthening international cooperation and advancing judicial practice to ensure the effective application of interim measures.
